For customers with minimal monthly checking needs, we offer a simple checking plan with a limit of 6 checks per statement cycle for a flat monthly service charge. Images of your checks are mailed with your statement at no additional charge.

OVERDRAFT PRIVILEGE

*Service Description Policy

It is important that you use your checking account responsibly and not intentionally overdraw your account. However, we realize that financial shortfalls happen from time to time and we offer options for you on those occasions. The services identified below may benefit you in the event that you inadvertently overdraw your checking account.

Overdraft Protection Options:

Savings Overdraft Protection – If you have a savings account with us we can link that account to your checking for automatic coverage; funds are transferred in increments of $100.00 as needed to cover overdrafts and a $5.00 fee is assessed for each transfer.

Overdraft Privilege – Overdraft Privilege is a service we link to your checking account to cover inadvertent overdrafts, subject to the eligibility criteria as explained below. With Overdraft Privilege we offer two coverage limits based on account type that generally pay your overdrafts items up to $400.00 or $700.00. However, the decision to pay your check(s) in whole or part from Overdraft Privilege funds (“overdraft”) is at the discretion of the Bank and we reserve the right not to pay such items for any reason. For example, we typically do not pay if your account is not in good standing, you are not making regular deposits, or you have too many overdrafts. The overdraft fee is $28.00 for each item presented with a maximum fee of $250.00 per day. Both the amount of the overdraft and $28.00 fee per paid item are included in this limit.

Eligibility- No application is required for Overdraft Privilege; eligibility is at the sole discretion of the Bank and is determined by taking into account the following criteria:

  • Your account must be opened for at least 30 days and at least $300.00 (good collected funds) deposited into an account and be in good standing;

  • Your account cannot be overdrawn within the first 30 days;

  • You cannot be past due on any Bank loan or delinquent on any other obligation to the Bank;

  • You cannot be subject to any legal or administrative orders, levy or are currently a party in a bankruptcy proceeding;

  • You cannot have an outstanding balance on an Overdraft Repayment Plan;

  • Must be 18 years or older;

  • You cannot have a ChexSystems record or any other negative indicator;

  • Your account must be active status and not inactive or dormant.

Eligible Account Types

  • Free Checking – up to $400 Overdraft Privilege

  • Personal Checking – up to $700 Overdraft Privilege

  • NOW Checking – up to $700 Overdraft Privilege

  • Basic Banking Checking – up to $700 Overdraft Privilege

  • Classic Checking – up to $700 Overdraft Privilege

Suspension/Revocation – Overdraft Privilege may be suspended or permanently removed from your account based on the following criteria:

  • You fail to deposit funds to cover the overdraft within 30 days of initiating an overdraft.

  • Your account type is not eligible.

  • We determine you are not managing your account in a responsible manner.

  • We do not have your valid address.

Transactions Eligible for Overdraft Privilege – Overdraft Privilege is available for all checks written, in-person withdrawals, ACH transactions, preauthorized automatic transfers, internet banking and telephone banking. Overdraft Privilege is NOT available for ATM and everyday debit card transactions unless you authorize the bank by completing an ATM/Debit Card Consent Form.

NOTE: If you have consented to Overdraft Privilege for ATM transactions, please verify your balance before initiating an ATM cash withdrawal. Any Overdraft or Non-Sufficient Funds charges will be subtracted from the Overdraft Privilege Limit.

Payment Order of Items -The order in which items are paid may affect the total fees assessed to your account. The first items we pay are ATM withdrawals, debit card transactions and any checks cashed by our branches or that you have written to us. Next we pay items that were submitted electronically, such as ACH items, preauthorized automatic transfers, telephone-initiated transfers and any other electronic transfers. Finally, we pay the remaining items in sequential check number order.

Opt Out – You may never need to take advantage of the Overdraft Privilege option but you may find it useful in the event of a temporary shortfall. If you receive a Direct Deposit, federal direct deposit, or any other entitlement benefit you must opt out if you do not want us to apply those funds to repay an overdraft.

Account Information – Your account agreement describes the duties, obligations, and rights of depositors, authorized signatories and the Bank with regard to your deposit accounts. The account agreement is incorporated herein for all purposes as if it were set forth verbatim as to matters not directly addressed by this disclosure.

Waiver – The Bank’s forbearance from, or delay in, exercising any of the Bank’s rights, remedies, privileges, or right to insist on your strict performance of any provisions of your account agreement, this Overdraft Privilege disclosure, or any other provision related to your account, shall not be construed to be a current or future waiver of the Bank’s rights, remedies or privileges.

Remedy - You and the Bank agree that the exclusive remedy and forum for all disputes arising out of the Overdraft Privilege or your or Bank’s performance there under, except for matters you or Bank take to small claims court, is arbitration by an independent arbitrator pursuant to the applicable rules of the American Arbitration Association, except as prohibited by law.

Effective Date – All information listed in this disclosure is effective as of August 24, 2012.
